About The Role:
As Senior Counsel, you will play a pivotal role in providing a broad spectrum of legal services to LifeMD.  We are seeking an individual who can lead strategic initiatives, work autonomously, and collaborate effectively within our Legal & Compliance teams.

In this role you will be a key member of our Legal team supporting all aspects of the legal function. Experience in the consumer-facing digital health space, healthcare technology industry, and/or ad-tech is strongly preferred.  There will be – at least initially – a particular focus on enterprise privacy initiatives and promoting privacy compliance across all business lines.

This is a hybrid position – 3 days in office.

Responsibilities:

  • Provide legal and compliance guidance to all business lines related to healthcare technology, privacy, digital advertising, marketing, and digital media in support of an expanding, comprehensive consumer healthcare platform
  • Ensure compliance with global, federal, and state privacy, data protection and healthcare laws, such as HIPAA, CCPA, CPRA and the FTC’s HBNR.  Monitor developments in global, federal, and state privacy laws and data protection regulations and assess their applicability to company products and services
  • Ensure company terms and conditions, privacy policies, customer consents, and related documents are kept up to date with changing business needs and an evolving regulatory landscape, and that such documents cohesively and logically integrate with one another
  • Ensure advertising and marketing compliance across company brands in various media forms (digital, print, social, audio and visual)
  • Liaise with advertising, marketing, and technology teams to review and approve steady flow of new and evolving creatives, and technology implementations

 

  • Conduct enterprise privacy training related to company privacy policies and relevant data protection laws and regulations. Work with technology and operations teams to incorporate privacy-by-design in product development and enhancement

Requirements

Basic Qualifications:

  • Juris Doctor degree from a top 25, ABA-accredited U.S. law school (and member of the bar of a U.S. jurisdiction)
  • 5+ years of legal experience
  • Big Law (AmLaw Top 50) background
  • Subject matter experience with state, federal, and global, privacy and data protection laws, such as CCPA/CPRA and other state privacy laws, GDPR, HBNR, and HIPAA

Preferred Qualification:

  • Big Law and/or in-house experience in healthcare technology, digital advertising/marketing, or in the consumer-facing digital health space, highly preferred.
  • Experience with Stark Law, Anti-Kickback, and Fraud Waste and Abuse Laws
  • Must embrace diving into unfamiliar areas of law and business, providing sound advice that balances risk relative to business interests
  • Ability to operate in a fast-paced, dynamic environment, navigating amid uncertainty with a can-do, problem-solving attitude
